1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of the ICD10Assist AI clinical coding software platform ("Service") provided by ICD10Assist AI Pty Ltd ("Company", "we", "us"). By accessing or using the Service, you agree to be bound by these Terms.
If you are using the Service on behalf of an organization (such as a hospital or health service), you represent that you have authority to bind that organization to these Terms.
2. Description of Service
ICD10Assist AI is an enterprise clinical coding assistant that provides:
- ICD-10-AM diagnosis code lookup and suggestions
- ACHI procedure code lookup and suggestions
- AR-DRG grouper integration
- Clinical coding compliance validation
- AI-assisted coding recommendations
- Workflow management tools
3. Eligibility
The Service is intended for:
- Qualified clinical coders and health information professionals
- Healthcare organizations and hospitals
- Health information management students (under supervision)
You must be at least 18 years old to use the Service.
4. Account Registration
To use the Service, you must:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Promptly notify us of any unauthorized access
- Accept responsibility for all activities under your account
5. Acceptable Use
5.1 You May:
- Use the Service for legitimate clinical coding purposes
- Access coding references and guidelines
- Generate coding suggestions and validations
- Export coding data for your organization's use
5.2 You May Not:
- Share account credentials with unauthorized users
- Attempt to reverse engineer or extract our algorithms
- Use the Service for fraudulent coding or billing
- Circumvent security measures or access controls
- Upload malicious code or interfere with the Service
- Use the Service in violation of applicable laws
- Resell or redistribute the Service without authorization
6. Intellectual Property
The Service, including its software, algorithms, user interface, and documentation, is owned by ICD10Assist AI Pty Ltd and protected by intellectual property laws. You receive a limited, non-exclusive license to use the Service in accordance with these Terms.
ICD-10-AM, ACHI, and AR-DRG classifications are maintained by the Independent Hospital Pricing Authority (IHPA) and used under applicable licensing.
7. Data Ownership
You retain ownership of any data you input into the Service ("Your Data"). You grant us a limited license to process Your Data solely to provide the Service. We do not claim ownership of Your Data.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:
- Warranties of merchantability and fitness for a particular purpose
- Warranties that the Service will be uninterrupted or error-free
- Warranties regarding the accuracy of coding suggestions
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ICD10ASSIST AI SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, or consequential damages
- Loss of profits, data, or business opportunities
- Damages arising from coding errors or compliance issues
- Damages exceeding the fees paid in the preceding 12 months
10. Indemnification
You agree to indemnify and hold harmless ICD10Assist AI from any claims, damages, or expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any law or third-party rights
- Coding decisions made using the Service
11. Termination
We may suspend or terminate your access to the Service:
- For violation of these Terms
- For non-payment of fees
- For fraudulent or illegal activity
- Upon written notice for any reason
You may terminate your account at any time by contacting support.
12. Changes to Terms
We may modify these Terms at any time. We will provide notice of material changes via email or through the Service. Continued use after changes constitutes acceptance of the modified Terms.
13. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be resolved in the courts of New South Wales.
14. Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in effect.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and ICD10Assist AI regarding the Service.
